AntNetwork, L.L.C., operating as RareSRV, guarantees at least 99.9% monthly availability for each active, paid hosting service covered by this schedule. This includes web hosting, reseller hosting, and dedicated servers according to the service boundary below. A specific order may promise a stronger commitment. A weaker commitment must not be advertised as covered by this 99.9% guarantee.
For shared and reseller hosting, availability means the hosting platform is reachable and able to serve a functioning test site, with the included platform components required to do so. A fault limited to a customer-managed application is treated separately. For a dedicated server, availability means the allocated hardware and RareSRV-provided network are operational at the agreed handoff point; customer-managed operating-system and application availability are outside that boundary unless the order includes their management.
Domain registration, third-party Internet connectivity, and the delivery time of an email to an external provider are not themselves uptime-covered hosting services. A separately sold DNS, email, or other service needs a stated service boundary before being advertised under this SLA. Access to RareBilling is not a substitute measurement for the availability of customer hosting.
Availability is calculated for each service in each UTC calendar month as 100 multiplied by eligible minutes minus qualifying unavailable minutes, divided by eligible minutes. Eligible minutes are the minutes the service was active and paid during that month, less only the narrowly defined exclusions below. Overlapping incidents count once.
At 99.9%, a full 30-day month with no exclusions allows 43 minutes and 12 seconds of qualifying downtime. A partial month uses the actual eligible minutes rather than a full-month denominator.
RareSRV will use timestamped monitoring and incident records to assess an interruption, and will consider reasonable customer evidence if our monitoring missed it. Reporting an incident does not artificially move its start time forward.
Qualifying downtime excludes an interruption caused by a customer's configuration, unsupported software, deliberate action, or failure to perform tasks expressly assigned to the customer; an authorized customer-requested change or suspension; a lawful suspension under the Terms; or connectivity outside the RareSRV and contracted hosting-provider service boundary.
Scheduled maintenance is excluded only if we give at least 48 hours' notice of its scope and window, and only up to four hours for that service in a calendar month. Time beyond that limit or outside the announced window counts if the service is unavailable. Unannounced emergency maintenance counts unless another specific exclusion independently applies.
An upstream hosting or network provider's outage is not automatically excluded when that provider supplies the service we sold. A denial-of-service incident is not automatically excluded merely because it originated externally. Any product-specific exclusion must be clear before purchase and must not contradict the advertised service boundary or protection.
If availability falls below the guarantee, the credit is a percentage of the affected service's recurring fee allocated to that month:
| Monthly availability | Credit on affected monthly fee |
|---|---|
| At least 99.9% | No SLA credit |
| At least 99.0% but below 99.9% | 10% |
| At least 95.0% but below 99.0% | 25% |
| At least 90.0% but below 95.0% | 50% |
| Below 90.0% | 100% |
For a longer billing term, divide the recurring term fee after discounts by the number of months in that term. Adjust partial months proportionately. One-time setup fees and unrelated products are excluded from the credit calculation. Total SLA credits for one service in a month cannot exceed that service's recurring fee allocated to the month.
Open a support request within 30 calendar days after the affected month ends. Identify the service, approximate incident times, and any useful evidence. We will assess the claim against the records and explain our decision. You can ask us to review a disagreement. No separate external monitoring subscription is required to make a claim.
Approved credits are applied to an open or future invoice. If the affected service has ended and you have no remaining service to which a credit can reasonably apply, we refund the approved credit amount to the original payment method where possible. A credit does not extend a service commitment unless you agree.
The SLA is the agreed contractual availability remedy, subject to statutory rights and other obligations that cannot be excluded. It does not replace the 14-day refund guarantee or our duty to correct a charge for an undelivered service. We do not reimburse the same service charge twice for the same loss; any lawful refund already paid is taken into account transparently.
