These Terms govern services supplied by AntNetwork, L.L.C., operating as RareSRV, a business based in New York, United States. “You” means the customer placing an order or the organization that customer is authorized to represent.
Your agreement consists of your accepted order, these Terms, the Fair Usage Policy, the Acceptable Use and Abuse Policy, the DMCA Policy, and any service schedule expressly included with the order. The Privacy Policy explains our handling of personal information. Specific terms clearly disclosed in an accepted order govern a direct conflict with general terms, subject to mandatory law. A signed data processing agreement governs the processing it covers.
You must be at least 18 and legally able to enter this agreement. If acting for an organization, you must have authority to bind it. Maintain accurate account and registrant information. These Terms do not transfer ownership of your content to us.
The product description and checkout state the service, configuration, price, currency, taxes, billing term, setup fees, and any material restrictions. Service activation depends on payment confirmation, required review, accurate details, provider availability, and successful provisioning. A payment confirmation is not a guarantee that setup is already complete.
If we cannot supply an accepted order, we will explain the issue and offer an agreed alternative or refund the amount paid for the unavailable service. We will not substitute a more expensive product without your consent. An obvious catalog error does not authorize an undisclosed charge; we will seek agreement on a corrected order or cancel and refund it.
Quotes can have a stated expiry and remain subject to the conditions disclosed in the quote. A staff-prepared cart or chat quote does not by itself authorize a charge. Orders with multiple items can have different activation dates, renewal dates, and fulfillment outcomes.
Where offered, plans can be billed monthly, every three months, every six months, every year, or every two years. “Two years” means 24 months; “semiannual” means six months. The displayed term price is the amount charged for the whole term, not necessarily a monthly charge. Domain registration periods and supplier-specific products may use different available terms.
A recurring service continues on the disclosed renewal terms until cancelled. Before you agree, we disclose the charge, frequency, renewal or cancellation deadline, and cancellation method. We provide a confirmation you can retain and applicable renewal or change notices. A promotional price applies only for its stated period; the later price must be disclosed.
Automatic collection from a saved payment method requires the applicable authorization. Paying a single invoice does not by itself authorize every future charge. You can withdraw an automatic-payment authorization through the available account controls or support. This stops future collection under that authorization but does not by itself cancel the underlying service or erase an amount already lawfully owed. Cancelling the recurring service stops future renewal charges for that service, subject to a separately accepted fixed commitment.
We give legally required notice of material changes and renewal price changes. Where required, we obtain fresh affirmative consent to an increased price before charging it. The existing paid term is not repriced retrospectively. Applicable mandatory cancellation and refund rights take priority over a notice or cutoff stated in an order.
You can cancel a recurring service through the client portal. If the control is unavailable, an authenticated support request provides an alternative. We will confirm the effective date and will not require a telephone call, acceptance of a retention offer, or payment of a disputed charge merely to stop future renewals. A billing or provisioning review must not prevent you from submitting a cancellation request.
Ordinary cancellation takes effect at the end of the current paid term unless you request an available earlier termination or a refund changes that date. Save your data before service ends. Dedicated servers may have an expressly disclosed commitment or supplier cancellation deadline; it must appear in the offer before purchase and cannot override mandatory rights. Cancelling a hosting service does not automatically cancel domain renewal or a separately purchased service.
An unpaid service may be restricted or suspended after applicable notice. The invoice, order, or account notice identifies relevant due dates and consequences. An unused failed checkout may be closed and removed from the active order view. Payments still processing or under review are not treated as definitively failed merely because the browser was closed or an error appeared. Financial and audit records may remain.
We do not guarantee that suspended hosting data will be kept indefinitely. Any routine deletion deadline and advance notice must be stated in the applicable service notice and match our published retention arrangements. A support request to cancel billing is different from a request to delete hosted files or personal data.
RareSRV offers a 14-calendar-day refund window beginning on the date of the initial transaction for a service, excluding separately disclosed one-time setup fees. A renewal is a continuation of an existing subscription and does not restart the initial-service refund window. You may request a renewal refund by opening a support ticket; such refunds are at RareSRV’s discretion except where a refund is required by law or these Terms. Unless a dedicated-server offer clearly states a different policy before purchase, the standard policy applies. Contact support through the client portal within the window and identify the order or invoice you want refunded.
For a qualifying request within the standard window, we refund the eligible service charge rather than reducing it by routine usage. The setup-fee exclusion does not allow us to retain a fee for setup we never supplied where a refund is required by law or these Terms. Applicable taxes are adjusted as required. We return an approved refund to the original payment method when possible; an account credit is not forced in place of a cash refund to which you are entitled.
Dedicated-server exceptions, including any nonrefundable commitment or prorated calculation, must be displayed with the specific offer and accepted before payment. Contact support if an offer needs clarification. An unpublished supplier rule or a general instruction to contact support does not silently remove the standard guarantee.
Outside the standard guarantee, any discretionary refund we approve is ordinarily prorated for the unused paid service period and excludes one-time setup fees. Unless a specific offer says otherwise, the calculation is the eligible recurring amount actually paid, after discounts, multiplied by unused days divided by total days in the paid period. Such exceptions are assessed individually and are not guaranteed. Required refunds, correction of unauthorized or duplicate charges, and mandatory consumer rights are not discretionary exceptions.
Your domain service is not categorically excluded from the stated 14-day policy. A completed registration, transfer, renewal, license, or other third-party transaction may be irreversible at that provider. RareSRV's refund obligation under the published offer is separate from whether an upstream provider returns its fee. A refund does not automatically undo a registry transaction or transfer a domain to RareSRV. We will explain the service and ownership consequences before completing the request.
An approved refund ends the refunded entitlement as described in the confirmation. Payment-provider processing times can vary. We avoid duplicate reimbursement for an amount already returned through a payment dispute, while preserving any remaining entitlement.
Contact support about a charge you do not recognize or believe is wrong so we can investigate. This is a request for early resolution, not a condition on your right to contact a bank, card issuer, regulator, or court. Nothing in this agreement waives a statutory billing-dispute right or requires you to withdraw a valid dispute before we review it.
Subject to applicable law, an abusive or fraudulent chargeback will result in termination of the associated RareSRV account and a permanent ban on opening or using other RareSRV accounts. We review the underlying evidence before making that determination. A legitimate dispute, unauthorized payment, or established RareSRV billing error is not automatically treated as abuse.
While a chargeback is pending, we may pause new purchases or restrict the affected service where reasonably necessary to address payment or fraud risk. We will give notice and a route to review where lawful and safe. A platform ban does not allow us to confiscate a customer's domain, keep money we must refund, destroy records we must preserve, or block rights the law protects. We do not impose an undisclosed chargeback penalty.
The order defines the resources and management included. A control panel does not mean that RareSRV manages every application, database, backup, or operating-system task. You are responsible for licenses, lawful content, and tasks outside the purchased management scope. We are responsible for the service obligations we expressly accept.
Resellers manage their own customer relationships, notices, support, and allocations unless the order states otherwise. They must pass on the relevant usage requirements and obtain rights to any information they give us. End-customer data remains subject to the applicable privacy and processing obligations.
A dedicated server may be supplied by a third party. The offer must disclose material location, hardware, commitment, refund, and management restrictions. Supplier delivery times and stock can change. We remain responsible to you for our accepted agreement and do not automatically transfer every upstream cost or undisclosed term to you.
RareSRV facilitates domain transactions through the registrar identified for the transaction; we do not represent that we are an ICANN-accredited registrar. Where Namecheap is the registrar, its Registration Agreement and relevant Supplemental Registry Agreement apply to the registration, together with applicable ICANN and registry rules. The checkout must identify any different registrar and applicable terms.
An availability result is time sensitive. A 15-minute cart hold only prevents competing holds inside RareSRV; it is not a registry reservation and cannot stop someone registering the name elsewhere. A domain is secured only when the registrar or registry confirms the transaction. If availability or price changes before acceptance, we seek your agreement or do not proceed.
Supply accurate registrant details and respond to verification requests. Registry and registrar rules can impose transfer locks, registration-data requirements, dispute procedures, expiry, redemption, and deletion consequences. A domain's contact or ownership change can trigger additional verification or a lock.
We disclose the offered registration, renewal, and restoration charges and any enabled automatic renewal before you agree. Keep your renewal choice and payment details current. Cancelling auto-renewal does not reverse an already completed renewal. Expiry recovery is time sensitive, may cost more, and is not guaranteed. The applicable registrar schedule must be made available before purchase; there is no universal grace period for every domain extension.
Keep a separate, current copy of important data. If your order includes a backup product, its schedule, retention, exclusions, and restore scope govern that product. Operational backups used to recover RareBilling do not automatically constitute a purchased backup service for every customer's hosted files. We do not promise that every file or historic version can be restored.
RareSRV guarantees 99.9% monthly availability for eligible hosting services under the attached Service Level Agreement. The SLA defines the service boundary, measurement, exclusions, claim process, and remedy. A domain registration by itself is not an uptime-monitored hosting service. We do not claim perfect availability or uninterrupted third-party Internet access.
You keep your rights in your content and grant us the limited rights needed to store, transmit, reproduce for backups, and otherwise process it to provide the service and follow lawful instructions. This does not give us a general right to sell your content or use it in advertising.
You must have the rights needed for content you upload and services you operate. Follow the Fair Usage, Acceptable Use and Abuse, and DMCA policies. Our software, branding, and materials remain owned by us or their licensors. A service purchase does not transfer those rights.
We may suspend or terminate for a material breach, nonpayment, serious security risk, unlawful activity, or a legal requirement. Where a breach can reasonably be corrected, we normally give notice and an opportunity to do so. Urgent harm or a binding legal requirement may require action first. We aim to limit a restriction to the affected service where practical.
If we discontinue a prepaid service for business reasons unrelated to your breach, we provide reasonable notice and refund the unused service portion unless you agree to an alternative. On termination, you remain responsible for lawful accrued charges, and we honor applicable refunds, data rights, transfer obligations, and preservation requirements. Records may remain as explained in the Privacy Policy.
We provide the service commitments expressly stated in the order and SLA and will exercise reasonable care and skill where required. Except for those commitments and rights that cannot lawfully be excluded, we do not give implied warranties of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation to the extent those exclusions are permitted.
To the extent permitted by law, neither party is liable to the other for indirect or consequential losses, including lost profit or lost business opportunities. RareSRV's aggregate contractual liability arising from an affected service is limited to the fees paid for that service during the 12 months preceding the event giving rise to the claim. This limit does not reduce an express refund or SLA credit obligation and does not exclude fraud, willful misconduct, gross negligence, or liability that cannot lawfully be limited. Mandatory consumer protections prevail.
A customer purchasing for business purposes will defend and indemnify RareSRV against a third-party claim arising from that customer's unlawful content, infringement, or deliberate misuse, to the extent caused by that customer. We will promptly notify the customer, allow a reasonable defense, and cooperate at their expense. No settlement may admit fault or impose a nonmonetary obligation on RareSRV without its reasonable consent. This clause does not cover a claim caused by RareSRV's own misconduct and is not imposed on a consumer where prohibited.
New York law governs this agreement to the extent permitted, without taking away mandatory protections of the customer's place of residence. Subject to mandatory jurisdiction rules, disputes may be brought in the competent state or federal courts in New York. Either party may seek available small-claims relief. These Terms do not impose mandatory arbitration or waive class proceedings.
We encourage a written support complaint so we can try to resolve a disagreement. This does not shorten a statutory deadline or prevent urgent or legally protected action. If one provision is unenforceable, the remaining provisions continue to the extent lawful.
We publish revisions with an effective date and give legally required notice or obtain consent before material changes apply. Continued use alone is not treated as consent where the law requires affirmative agreement. A revision does not retroactively change an accepted paid term or already accrued claim.
